Terms of Service

By downloading, installing, or using Landefy, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

If you are using Landefy on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Landefy is operated by Innov8ProTech Ltd, a company registered in Ghana with its registered address at St. Mark Street, Com 18, Tema, Ghana. In these Terms, "we", "our", and "us" refer to Innov8ProTech Ltd.

You must be at least 18 years old to use Landefy. By using the Service, you confirm that:

• —You are 18 or older.
• —You have the legal capacity to enter into these Terms.
• —You are not barred from using the Service under the laws of Ghana or your country of residence.
• —All information you provide to us is accurate and complete.

To use most features of Landefy, you must create an account. You agree to:

• —Provide accurate and current information when registering.
• —Keep your password and login credentials secure.
• —Not share your account with anyone else.
• —Notify us immediately if you suspect unauthorised access.
• —Complete Ghana Card verification where required for KYC compliance.

You are responsible for all activity that occurs on your account. We are not liable for any loss arising from unauthorised use that results from your failure to keep your credentials secure.

Landefy offers four subscription tiers:

• —Starter: free, one check per month.
• —Single Check: GH₵120 per report, no subscription.
• —Pro: GH₵400 per month, up to 100 checks per month.
• —Business: GH₵2,499 per month, up to 1,000 checks per month, plus API access and team seats.

Prices are in Ghanaian cedis and include applicable taxes unless otherwise stated. We may change prices from time to time. Material changes will be communicated at least 30 days in advance.

Payments are processed through licensed payment service providers including mobile money operators (MTN MoMo, Telecel Cash, AT Money) and card processors. By making a payment, you authorise us to charge your chosen payment method.

For subscription plans (Pro and Business), payment is due in advance. Subscriptions automatically renew unless you cancel before the renewal date.

For Business tier invoicing, payment terms are stated in your contract. Late payments may result in suspension of the Service.

Single Check: If we are unable to return any verified result for a parcel you have paid to check — because it is not in the registry or source data is incomplete — the check does not count against your quota and you are entitled to a full refund on request.

Pro and Business subscriptions: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide partial refunds for unused time in the current period, except where required by law.

Statutory rights: Nothing in this policy affects any statutory rights you may have under Ghanaian consumer protection law.

You agree not to use the Service to:

• —Violate any law, regulation, or court order in Ghana or elsewhere.
• —Infringe the rights of any third party, including intellectual property and privacy rights.
• —Scrape, harvest, or bulk-extract data from the Service except as expressly permitted through our Business tier API.
• —Resell, sublicense, or redistribute our parcel data or reports without a written reseller agreement.
• —Impersonate another person or misrepresent your affiliation with any person or entity.
• —Interfere with or disrupt the Service, or attempt to gain unauthorised access to any systems.
• —Use the Service to harass, threaten, or defraud any person.
• —Use automated systems to access the Service except through our documented API.

We may suspend or terminate your account if we determine, in our reasonable judgment, that you have violated these rules.

Please read this section carefully. It affects your legal rights.

Landefy aggregates records from the Lands Commission, court registries, the Office of the Administrator of Stool Lands (OASL), the Survey Department, and licensed surveyors. Every result shows you the source of the data and the date it was last updated.

We do not produce or edit the underlying records. We return exactly what the source says. If the Lands Commission record is wrong, our result shows that the record is wrong — we don't correct it.

Landefy is not a substitute for legal advice. Our reports are a first check, not a final answer. For any transaction involving significant value, we strongly recommend you engage a qualified lawyer to conduct formal due diligence.

Data has limits. No database is complete. A parcel not appearing in Landefy may still exist. An absence of litigation in our records does not guarantee that no litigation exists. We make no warranty that the Service is accurate, complete, or up to date at any specific moment.

Your decisions are your own. Any decision you make — to buy, sell, lease, mortgage, or otherwise deal with land — is your responsibility. We are not liable for any loss arising from a decision you make based on information from the Service.

The Service, including the Landefy name, logo, software, and original content, is owned by Innov8ProTech Ltd and protected by Ghanaian and international intellectual property laws.

Reports you generate through the Service are yours to use for your own purposes. You may share them with your lawyer, bank, or other advisers. You may not resell them or publish them for commercial purposes without our written permission.

Underlying parcel and litigation records remain the property of their original sources.

We aim to keep Landefy available 24/7, but we do not guarantee uninterrupted access. The Service may be unavailable during:

• —Scheduled maintenance, which we will announce in advance where possible.
• —Downtime of our upstream data sources (Lands Commission, court systems).
• —Network or infrastructure failures outside our control.
• —Force majeure events including natural disasters, war, or government action.

Business tier customers receive a written Service Level Agreement with uptime commitments and remedies. Starter, Single Check, and Pro users do not receive an SLA.

To the maximum extent permitted by Ghanaian law, Innov8ProTech Ltd shall not be liable for:

• —Indirect, incidental, consequential, or punitive damages.
• —Loss of profit, revenue, business opportunity, or goodwill.
• —Loss arising from decisions made based on data from the Service.
• —Damage caused by interruptions to the Service or inaccuracies in third-party data.

Our total liability arising out of or relating to these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) GH₵500.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence.

You agree to indemnify and hold Innov8ProTech Ltd, its directors, officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• —Your violation of these Terms.
• —Your violation of any law or third-party right.
• —Your use of data or reports from the Service for purposes we have not authorised.

You may terminate your account at any time through the app settings. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (Intellectual Property, Limitation of Liability, Indemnification, Governing Law) continue to apply.

These Terms are governed by the laws of the Republic of Ghana. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ghana.

Before pursuing formal legal action, both parties agree to attempt to resolve any dispute through good-faith negotiation. If negotiation fails, the parties may agree to mediation through a mutually acceptable mediator in Accra.

Nothing in this section prevents either party from seeking urgent injunctive relief from a court where necessary.

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
